Projet de recherche Titre projeté du mémoire ou de la thèse : “Intersection of Legalities in Samoa: Banishment Cases and the Negotiation of Legal Pluralism” In my work, I develop an interdisciplinary, theoretical framework for analyzing legal pluralism in banishment cases in Samoa. I draw upon theoretical forms, discourses and practices from legal anthropology, comparative legal scholarship and law and society studies to critically analyze the intersections of different legalities in Samoa, and the ways in which they are negotiated. As part of my analysis, I employ two metaphors. The first metaphor, woven objects, is employed to represent select strands of legality existent in Samoa. The second metaphor, the weaving process, is used to analyze how legal pluralism is negotiated in Samoan banishment cases through the adoption of particular subjectivities, through articulation of legal information, and via relations of power. |
