On the Use and Misuse of Anthropology before Canadian Courts

The focus of my project is the use of anthropological theory/representations of Indigenous peoples in legal proceedings regarding their rights and title. I will detail a history of anthropological science, and introduce a connection of this work to examples in Canadian aboriginal rights jurisprudence, such as Van der Peet, Delgamuuk’w, and the present Xeni Gwet’in title case. I will attempt to demonstrate relevance between the politics of anthropological conceptualisations of aboriginal societies and present law.
