Intersocietal Law in the Modern Age of Treatymaking in British Columbia – A Decolonizing Vision for Co-existence
The presentation contains a short overview of major themes in my dissertation, a work in progress. It encompasses three main topics or lines of inquiry.
1) The concept of intersocietal law as it applies to the relations of Aboriginal and non-Aboriginal societies and its historical, philosophical and jurisprudential foundations. The conceptual framework for this line of inquiry is a critique of Brian Slattery’s theory of intersocietal law.
2) A reformulation of the concept of intersocietal law. This inquiry draws on Jeremy Webber’s seminal work on intersocietal law theory and other sources.
3) A study of the BC treaty process conducted within the framework of intersocietal law theory.
